Due largely to the war on drugs, Kentucky has lengthened sentences and added too many “penalty enhancers” that require extra prison time even for non-violent offenders, several lawmakers said. The state also has neglected addiction treatment and inadequately funded community supervision programs that provide a cheaper alternative to prison, they said.

“These addicts are demon-ized to the point where prison is seen as the only option for them, not only by the courts but also by the community,” said Rep. Robin Webb, D-Grayson, a member of the House budget and judiciary committees.

“Look at Operation UNITE, which is a well-meaning anti-drug program that’s heavy on arrests and incarceration and light on everything else,” Webb said.

Said House Judiciary Chairwoman Kathy Stein, D-Lexington, “Possession of two items of drug paraphernalia is a felony. Now, how stupid is that?”

The Senate last month unanimously passed a bill to establish an intensive addiction treatment program for people charged with felonies. Court officials would screen suspects in less serious felonies shortly after arrest. Those with a relevant addiction problem could be sent to a secured 200-bed facility or, if it’s considered safe, to other residential drug-treatment programs. The bill now awaits House action.
